The U.S. Securities and Exchange Commission (SEC) has filed a motion urging the court to grant its request for an appeal in the Ripple Labs lawsuit. The agency disagrees with the court’s ruling that XRP was not a security when sold to retail investors and believes there are complex legal issues that need to be addressed.
In a filing submitted on September 8th, the SEC called for the U.S. District Court for the Southern District of New York to grant its motion for interlocutory appeal and to stay further proceedings until the resolution of that appeal. The agency argued that the issues raised by the court’s order on summary judgment present the kind of “knotty legal problems” that warrant an interlocutory review.
In July, Judge Analisa Torres ruled that XRP is generally not a security under SEC guidelines, especially when distributed through programmatic sales. However, the SEC now argues that the rulings on programmatic sales and other types of distributions raise legal questions that are significant enough for the court to approve its interlocutory appeal. The agency highlighted contradictory legal conclusions reached by different courts on similar issues.
This stance seems to contradict previous statements from the SEC and its chairman Gary Gensler. Gensler has previously asserted that the SEC already has clear guidelines that cover the crypto market and has pushed back against the need for new crypto regulation. However, the agency now claims that there are complex legal issues that require urgent resolution.
Ripple’s chief legal officer, Stuart Alderoty, criticized the SEC’s filing as hypocritical, pointing out that the agency has previously emphasized the importance of following clear rules. Coinbase’s chief legal officer, Paul Grewal, echoed Alderoty’s statement and questioned how crypto firms can be on “fair notice” if there are unresolved legal questions.
The SEC initially moved to appeal and stay the decision from Judge Torres in August, arguing that there were substantial differences of opinion. Ripple Labs responded by filing a memorandum of law opposing the SEC’s appeal, arguing that the agency had insufficient grounds to request an appeal.
This ongoing legal battle between Ripple Labs and the SEC highlights the uncertain regulatory landscape surrounding digital assets. The outcome of this case could have significant implications for how cryptocurrencies are classified and regulated in the future.
